Bird Dog — Terms of Service

These Terms govern your use of Bird Dog ("Bird Dog," "we," "us"), operated as a sole proprietorship (business-entity formation pending; these Terms will be updated with the entity name when it forms). By using Bird Dog, you agree to these Terms. If you don't agree, don't use the service. Contact: [email protected].
1. What Bird Dog does
Bird Dog reads U.S. federal solicitations (sourced from SAM.gov, public government data) and surfaces the ones that fit the capability profile you provide, with reasons. You are paying for our matching and curation work — the finding — not for the underlying solicitation data, which is public and free on SAM.gov. After you unlock an opportunity you can also find it yourself on SAM.gov; that's expected and fine.
2. Eligibility & accounts
You must be at least 18 and authorized to act for your business. You sign in via Google or Microsoft; you're responsible for keeping that account secure and for activity under your Bird Dog account.
3. Payments — unlocks, passes, subscriptions, refunds
- Pay-per-unlock: a one-time fee (currently $9.99) to unlock one opportunity's full details (including a direct SAM.gov link) plus amendment-watch through that opportunity's close date.
- 7-day pass: a one-time fee (currently $24.99) unlocking everything you view for 7 days.
- Monthly subscription: a recurring fee (currently $49/month) that unlocks every match and keeps continuous watch on your whole profile. Cancel anytime from your account page; your access runs to the end of the period you paid for and billing stops — no cancellation hoops, no lock-in. We will never make canceling harder than subscribing.
- NO CASH REFUNDS — with one guarantee. Because an unlock delivers its full value immediately (and the underlying data is public), unlocks, passes, and subscription charges already incurred are non-refundable as cash. First-unlock satisfaction guarantee: if your first unlock turns out to be a bad match, report it via "Report a bad match" on your matches page and we automatically credit you one free replacement unlock to use on any opportunity. This credit is the exclusive remedy for a bad first match; it is a service credit, not cash. For any other match you believe is wrong, the report still directly tunes your future results.
- Payments are processed by Stripe; prices may change prospectively (changes won't affect a purchase already made, and a subscription price change takes effect only from your next billing period with notice).
4. Acceptable use
You agree not to: - scrape, bulk-download, resell, or redistribute Bird Dog's matches, teasers, or compiled data; - circumvent the unlock/paywall, share unlocked content to evade fees, or probe/breach security; - use the service unlawfully, or to misrepresent any affiliation with the U.S. Government (Bird Dog is not a government service and is not affiliated with SAM.gov or any agency).
5. Intellectual property
The underlying solicitation data is public-domain U.S. Government work. Our matching, scoring, paraphrasing, curation, and the Bird Dog software and brand are ours. We grant you a personal, non-transferable license to use the service for your business; we reserve all other rights.
6. No guarantees — important
Bird Dog is an informational tool. We do not guarantee: - that any matched opportunity is accurate, complete, current, or suitable for you; - that we will surface every relevant opportunity, or that any match will result in an award; - the accuracy or timeliness of data sourced from SAM.gov (which may contain errors, delays, or omissions outside our control).
You are responsible for independently verifying any opportunity on SAM.gov and confirming deadlines, eligibility, and requirements before relying on it or submitting a bid. Bird Dog is not legal, financial, or procurement advice.
7. Disclaimer of warranties
The service is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
8. Limitation of liability
To the fullest extent permitted by law, Bird Dog and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost business, or a missed or lost contract opportunity. Our total liability for any claim relating to the service will not exceed the greater of (a) the amount you paid us in the 3 months before the claim, or (b) US $50.
9. Indemnification
You agree to indemnify and hold harmless Bird Dog and its operator from claims arising out of your use of the service or your violation of these Terms.
10. Termination
You may stop using Bird Dog and delete your account at any time. We may suspend or terminate access for violation of these Terms or to protect the service. Sections that by their nature should survive (payment, IP, disclaimers, liability, indemnity) survive termination.
11. Governing law
These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-laws rules. Disputes will be brought in the state or federal courts located in Missouri.
12. Changes
We may update these Terms; we'll update the "Last updated" date and, for material changes, provide notice. Continued use after changes means you accept them.
